自然资源作为人类生存和发展的根基,其产权制度的构建应当在满足经济效益的同时符合可持续发展的要求。行政特许是我国自然资源配置采用的重要方式。随着市场在资源配置中决定性作用的确认,自然资源特许使用权制度之健全与完善已刻不容缓。本文探讨了自然资源特许使用权的私权内涵,研究了自然资源特许使用权制度市场化的合理性,最后对自然资源特许使用权的市场化制度构建进行了展望。
As the foundation of human existence and development, natural resources should be constructed to meet the requirements of sustainable development while meeting the economic benefits. Administrative concession is an important way adopted by China’s natural resource allocation. With the confirmation of the decisive role of the market in the allocation of resources, it is imperative to improve and perfect the system of the concession of natural resources. This paper explores the connotation of the private right of the concession of natural resources, studies the rationality of marketization of the concession of natural resources, and finally puts forward the prospect of establishing the marketization system of the concession of natural resources.
