侵犯商业秘密罪是《刑法》第二百一十九条规定的罪名,这一罪名在刑事司法实践中并不多见,且由于该类案件具有专业性、秘密性、多样性等特点,使得这一犯罪在实践中认定较为困难,本文以冀某、胡某侵犯商业秘密罪为例,阐述了商业秘密的概念和特点,分析了侵犯商业秘密罪的犯罪构成以及对权利人造成损失的认定,以期对司法实践提供有益借鉴。
