识别是国际私法最复杂、最艰深的问题之一。识别是准确适用法律选择规则的开始,不仅对适用冲突规范具有意义,且对确定管辖也有影响。本文认为,识别问题产生的根源是各国的法律传统、法律观念的差异,具体表现在语言的差异。通过对传统识别理论的检讨,着眼于语言与法律的密切关系以及法学语言学转向的新趋势,我们可以从维特根斯坦语言哲学中的“语言游戏”、“生活形式”等概念出发,为识别问题的解决开辟新路径。
Identification is one of the most complex and difficult questions of private international law. Identification is the beginning of the rule of law selection that applies correctly, not only to the application of conflict rules, but also to the determination of jurisdiction. This paper argues that the root causes of identification problems are the differences of legal traditions and legal concepts in different countries, which are manifested in different languages. By reviewing the traditional recognition theory and focusing on the close relationship between language and law and the new trend of jurisprudence linguistics, we can learn from the concepts of “language game ” and “life style ” in Wittgenstein’s language philosophy Starting, to identify the problem to solve a new path.
