看了“‘坦白’是‘从宽’的充分条件吗”一文(载《逻辑与语言学习》一九八七年第六期,下简称《王文》)后,我有不同的看法。我认为,“坦白”是“从宽”的充分条件,而不是必要条件。《王文》说:坦白是否从宽,“这要由犯罪的性质决定。”又说:“某些较轻的罪行,犯罪分子主动坦白,是可能得到从宽处理的;但某些犯罪分子由于罪大恶极,不杀不足以平民愤,虽然犯罪分子在犯罪后能够坦白犯罪事实,也是不能从宽处理
