现今就我国“《物权法》”而言并没有针对不动产物权(以下英文简称REI)以及动产物权两者之间的善意取得予以明确区分,更没有关于冒名处分他人不动产(以下英文简称FPORE)在善意取得方面的适用规定。理论界当前对于FPORE能否在善意取得相关制度中予以适用具有不同的看法,而本文基于此就FPORE予以概述,然后探讨善意取得相关制度需要排除FPORE适用。以期为后续关于FPORE方面以及REI方面的研究提供理论上的参考依据。
Nowadays, China does not make a clear distinction between the acquisition of REIs and the acquisition of goodwill between the two parties in the realm of property law, and there is no clear distinction between imposing others’ real property (hereinafter referred to as " FPORE) in the good faith acquisition of the applicable provisions. Theorists at present have different opinions on whether FPORE can be applied in the system of bona fide acquisition. Based on this, the article gives an overview of FPORE and then discusses how to obtain FPORE in good faith. With a view to provide theoretical reference for the follow-up study on FPORE and REI.
