2002年11月30日,陕西省白河县公安局交警大队民警在316国道巡查时,发现该县月镇村村民严某驾驶的四轮农用运输车,挂着由白河县农机站办理的拖拉机号牌(牌号:陕西C09901)上路,遂依法收缴了这个号牌。严某不服,在向农机部门追要购车手续未果的情况下,以交警大队行政强制措施无法律依据为由,向白河县人民法院提起行政诉讼。2003年2月26日,白河县人民法院开庭审理此案,经审理认为,根据《国务院法制办对最高人民法院行政审判庭关于农用运输车管理问题征求意见函的答复意
