多边贸易体制倡导消除有损自由贸易精神的单边贸易壁垒。GATT一般例外条款可作不同的理解,引发了WTO成员基于人权目的采取的单边贸易限制或禁止行动,是否会违反贸易自由精神的问题。普惠制和最惠国待遇制、国家安全例外最易激起贸易自由化与人权制裁的价值冲突。国际条约解释方法对自由贸易与人权价值的冲突,能够起到一定的调和作用。
The multilateral trading system advocates the elimination of unilateral trade barriers that undermine the spirit of free trade. The GATT General Exceptions can be interpreted differently, triggering unilateral trade restrictions or prohibitions by WTO members based on human rights, and whether it would violate the spirit of trade freedom. GSP and MFN regimes, national security exceptions most easily aroused the value of trade liberalization and human rights sanctions conflict. The method of interpretation of international treaties can have a certain moderating effect on the conflict between the value of free trade and human rights.
