2012年《中华人民共和国刑事诉讼法》第93条新增了人民检察院对批准逮捕后羁押的必要性审查权能,但是立法层面的规定仍显得较为笼统,需要后续的立法、司法解释进行细化。本文从未决羁押的功能定位出发,探讨羁押必要性审查制度建立与完善中的审查标准问题、程序启动问题,并从司法惯性、司法程序中“行政审批”模式和办案人对错案风险的规避等角度预估羁押必要性审查制度的风险,希望能够为我国进一步完善羁押必要性审查制度提供一些参考和借鉴。
In 2012, Article 93 of the Criminal Procedure Law of the People’s Republic of China added the power of people’s procuratorate to review the necessity of detention after arrest. However, the legislative provisions still appear to be more general and require further legislative and judicial interpretation. This article starts from the functional orientation of pending detention, and discusses the problems of reviewing standards and procedures in establishing and perfecting the review system of detention necessity. From the perspectives of judicial inertia and judicial procedures, the mode of “administrative examination and approval” It also hopes to provide some reference and reference for our country to further improve the system of censorship of detention.
