逮捕作为我国最严厉的强制措施,在无罪推定原则之下,其本身的正当性及如何实施是正当的问题不无探究的必要.作为一项诉讼制度,逮捕应当纳入到整个刑事诉讼中予以审视,满足程序正义的要求.理论上需要对逮捕作为国家强制力行使的正当性提供解释和支持.
