纯正身份犯的共犯问题是整个共犯与身份问题的核心。在无身份者能否构成有身份者实施的真正身份犯的共同实行犯这一问题上,还存在异议,本文认为应以无身份者能否参与真正身份犯的部分实行行为为标准来判断无身份者是否可以成立有身份者的共同实行犯。在无身份者教唆、帮助有身份者实施真正身份犯的定性上,可以考虑采用“核心角色说”并结合“法益衡量补充规则”的方法来解决这一问题;在有身份者教唆、帮助无身份者实施真正身份犯的定性上,宜将有身份者作为间接正犯处理。
