2002年12月9日,澳大利亚航空公司(以下简称澳航)和新西兰航空公司(以下简称新航)共同向澳大利亚竞争与消费者委员会ACCC(Australian Competition and Con-sumer Commission)及新西兰商业委员会NZCC(New Zealand Commerce Commission)提交了申请,要求对澳航与新航的战略联盟协议给予批准。ACCC和NZCC分别于2003年9月9日和2003年10月23日做出最终裁决,认定双方的战略联盟“不符合公众利益(not in public interest)”,予以否决。本文拟就ACCC及NZCC对双方战略联盟的审核过程及其最终否决的理由进行分析,希望能够对我国监管部门规制航空公司战略联盟有所启示。
On December 9, 2002, Qantas Airways and Air New Zealand jointly issued a letter to the Australian Competition and Consumer Commission ACCC (Australian Competition and Consumer Commission) and New Zealand Business Council NZCC (New Zealand Airways) Zealand Commerce Commission submitted an application for approval of the strategic alliance agreement between Qantas and Singapore Airlines. ACCC and NZCC made the final ruling on September 9, 2003 and October 23, 2003, respectively, rejecting their strategic alliance “not in public interest”. This article intends to analyze the review process of ACCC and NZCC on the strategic alliance between the two parties and the reasons for the final rejection, hoping to enlighten our country’s regulatory department in regulating the strategic alliance of airlines.
