出版自由是广义的言论自由的有机构成部分,是用文字形式表达思想和交流思想的自由,出版自由是现代社会公民的一项基本权利,本文从比较法确度,运用比较研究的方法,论述出版自由的人权法保障,分析各国的书报检查制度对出版自由的限制功能,揭示出版法的本质是对出版自由的保障,同时也探讨了出版自由的合理限度及其法律机制。
Free press is an organic part of generalized freedom of speech, freedom to express ideas and exchange ideas in the form of words. Freedom of the press is a basic right of citizens in modern society. From the perspective of comparative law and comparative study, The freedom of publishing, the protection of human rights law, analyzes the restriction function of newspapers and periodicals inspection system in various countries to the freedom of publication, and reveals that the essence of publication law is the guarantee of the freedom of publication. Meanwhile, the reasonable limits of publishing freedom and its legal mechanism are also discussed.
