现代社会,与经济高速发展伴生的是各种类型的新型纠纷,如噪声污染纠纷,它们往往涉及人数众多的群体利益而非一两个人的个体利益。如何快速、公正地解决这些纠纷,是理论和实务界亟待研究的问题。本文拟通过对主要国家群体诉讼纠纷解决机制的比较,分析我国实践中的案例,提出改革的建议,以期对完善我国群体诉讼纠纷解决机制有所裨益。
In modern society, along with the rapid economic development, various types of new disputes, such as disputes over noise pollution, often involve a large number of group interests rather than the individual interests of one or two individuals. How to solve these disputes quickly and justly is a problem to be studied urgently by both theory and practice circles. This article intends to analyze the solutions to disputes in major national groups by analyzing the cases in our country and putting forward the proposals for reform so as to bring some benefits to the dispute settlement mechanism in our country.
