随着国际航空客运事业的发展,国际航空客运中的民事纠纷将逐渐增多,若要协调好航空客运中的各种民事关系和处理好各种民事纠纷,就必须依靠法律。目前,调整航空旅客及行李运输合同的国际条约,处于主导地位的是“华沙体制”。华沙体制由1929年《华沙公约》以及修改或补充该公约的1955年《海牙议定书》、1961年《瓜达加哈拉公约》、1971年《危地马拉议定书》、以及1975年蒙特利尔四个议定书构成。与该体制相衔接的还有各航空公司订立的一系列协议,它们成为调整航空旅客及行李运输合同的国际惯例。
With the development of international air passenger transport, civil disputes in international air passenger transport will gradually increase. If it is necessary to coordinate various civil relations in air passenger transport and handle various civil disputes, it must rely on the law. At present, the international treaty regulating air passenger and baggage transport contracts is dominated by the “Warsaw system.” The Warsaw system consists of the Warsaw Convention of 1929 and the Hague Protocol of 1955 amending or supplementing the Convention; the Guadaljaldis Convention of 1961; the Guatemala Protocol of 1971; and the 1975 Montreal Protocol. Also linked to the system are a series of agreements concluded by airlines that have become international conventions for regulating the contract of air passenger and baggage transport.
