在“司法改革”这一“中心话语”下 ,中国基层司法机关的改革如火如荼 ,但是 ,由于改革的自发性和分散性 ,导致了诸多悖论的产生。为此 ,中央决定转变改革模式 ,成立了中央司法改革领导小组 ,以指导全国司法体制改革工作的进行。这一决定对于中国司法改革的历史进程来讲 ,无疑具有里程碑意义 ,必将对中国司法改革进程产生深远影响。综合来看 ,成立司法改革领导小组 ,才能除司法改革进程中的非理性色彩 ;才能沟通司法改革中的精英意识与大众诉求 ;才能调谐司法改革与政治体制的深层冲突。
Under the “central discourse of judicial reform”, the reform of grassroots judicial organs in China is in full swing. However, due to the spontaneous and dispersive nature of reform, many paradoxes have emerged. To this end, the Central Committee decided to change the reform model and set up a leading group for the central judicial reform in order to guide the work of reforming the national judicial system. This decision is undoubtedly a milestone for the historical process of China’s judicial reform and will surely have a profound impact on the process of judicial reform in China. Taken together, the formation of the leading group for judicial reform can eliminate the irrational color in the process of judicial reform, and can communicate the elitism and popular demands in judicial reform. Only in this way can the deep conflicts between judicial reform and political system be reconciled.
