2009年,曹德旺以70%福耀玻璃的股份(市值约35亿人民币)成立慈善基金开创了中国以股权运作的基金的先河。中国政法大学赵旭东教授在接受《法人》记者专访时,认为此基金最大的两个法律研究价值在于其性质和受托人失范时的救济。因此本文就股权式运作基金的这两个方面进行初步探讨。
In 2009, Mr. Cao set up a charitable fund with a stake of 70% of Fuyao Glass (market capitalization of about RMB3.5 billion) and created a precedent for China ’s equity - backed fund. Zhao Xu-dong, professor of China University of Political Science and Law, accepted an exclusive interview with a reporter of “legal person” and concluded that the two largest law research values of the fund lie in its nature and relief when the trustee is out of control. Therefore, this article discusses the two aspects of equity fund.
