在诉讼活动中对两个事实之间有无联系、联系程度的最终确认,与认识主体的认知过程直接相关。通过证据立法对关联性作出明确的界定存在着巨大的技术障碍,而企图从理论上对关联性制定明确的标准则是迄今为止未能实现的愿望。但将抽象的属性尽可能细化,对司法实践却有着重要的参照价值。一个具体的证据与案件事实之间的关联性,应当被理解为六个字:内在、客观、必然,即证据与案件事实之间应该具有内在的、客观的、必然的联系。
There is no connection between the two facts in the litigation activities, the final confirmation of the contact degree is directly related to the cognition process of the subject. There is a tremendous technical hurdle to clearly define relevance through evidence legislation, and attempts to establish a clear standard of relevance in theory are by no means achievable. However, as far as possible the abstract attributes of the refinement of the judicial practice has an important reference value. The relation between a concrete evidence and the facts of the case should be understood as six words: internal, objective and necessary, that is, there should be an intrinsic, objective and necessary connection between the evidence and the facts of the case.
