在新的世界格局背景中,当代各个主权国家共同面对的是现代国家建构问题。现代国家的特质是共同的,但每个国家所面对与要解决的问题却各有各的不同。中国作为一个后发国家,正处于现代国家建构的过程之中,藉此实现从传统到现代的转型。这是一个不间断的过程,也是一个艰难的过程。因此,需要突破宪法学思维的局限,以现代国家理论为分析视角,破解在现代国家建构中出现的种种困难。在现代国家理论视域中,宪法实施对建构现代国家的作用是多维度的。宪法实施在强化国家认同、树立规则意识、通过普遍的公共参与模式塑造集体人格等方面的作用不可替代。宪法实施对建构现代国家的现实意义值得深入探讨和挖掘。
In the context of the new world structure, all sovereign countries in the world are confronted with the question of the construction of a modern state. The traits of modern countries are common, but the problems that each country faces and needs to be solved are different. As a latecomer country, China is now in the process of building a modern nation and thereby realizing its transformation from tradition to modern times. This is an uninterrupted process, but also a difficult process. Therefore, it is necessary to break through the limitations of constitutional thinking and analyze the difficulties that have emerged in the construction of the modern state from the perspective of modern state theory. In the modern state theory, the role of constitutional enforcement in building a modern country is multidimensional. The role of constitutional enforcement in strengthening national identity, establishing a sense of the rules and shaping a collective personality through a common model of public participation is irreplaceable. The practical significance of the implementation of the Constitution in building a modern country deserves further exploration and excavation.
