西方国家宪法上的财产征收条款的逻辑是限制国家征收权的运用,而我国当前的宪法上的财产征收条款的逻辑是授予国家征收权。为了加强公民和集体的财产权的保护,应当采用限权的逻辑来完善宪法上的财产征收条款,限制国家征收权的运用。
The logic of the constitutional expropriation provisions in the western countries is to limit the use of the state’s expropriation power. The logic of the current constitutional property expropriation clause in our country is to grant the state the right of expropriation. In order to strengthen the protection of citizens and collective property rights, the logic of limitation should be used to improve the constitutional provisions on the collection of property and restrict the use of the power of state collection.
