新修订的《消费者权益保护法》颁布,对消费者的权益保护方式作出了较大的调整,为了适应网络购物的普及,做了大幅度的修改。其中关于消费者协会可以提起公益诉讼的规定,更是在民事诉讼法对公益诉讼立法后,第一次在实体法中作出了具体的规定。而在司法实践中,如何具体适用该规定,消费者如何利用该规定维护自己的合法权益,消费者协会又如何介入诉讼,并没有相关详细的司法解释予以规定,在司法实践的掌握中仍存在一定的困难,存在着诸多问题仍有待解决。
The newly revised Law on the Protection of Rights and Interests of Customers promulgated a larger adjustment on the protection of consumers’ rights and interests and made drastic changes in order to adapt to the popularity of online shopping. Among them, the stipulation that the consumer associations can bring public interest litigation is the first time that the civil litigation law makes specific provisions in the substantive law after the legislation on public interest litigation. In judicial practice, how to apply this regulation concretely, how consumers use the regulation to safeguard their own legal rights and interests, how to intervene in litigation by consumer associations, and there is no relevant detailed judicial interpretation to be regulated and still exist in the judicial practice Some difficulties, there are many problems still to be solved.
