陆幽诉黄健翔名誉侵权案是网络侵犯名誉权的典型案例,折射出很多法律适用问题。本文首先介绍了案件详情,然后从众多问题中选取了损害事实中“社会评价”的界定、“特定受害人”的界定以及网络名誉权侵权的特殊性三个方面分析了该案涉及到的名誉权规范基础,指出其中存在的问题并提出适用方法。并通过这三方面的分析,进一步指出我国现有规定名誉权侵权的法律法规整体上出现的问题,提出了完善建议。
Luyou Huang Jianxiang reputation infringement case is a typical case of network infringement of reputation, reflects a lot of legal issues. This article first introduces the details of the case and then analyzes the case from three aspects: the definition of “social appraisal”, the definition of “specific victim” and the particularity of infringement of reputation on network Related to the basis of the right to reputation norms, pointed out the problems and put forward the applicable methods. Through the analysis of the three aspects, it further points out the problems existing in the existing laws and regulations on infringement of reputation rights in our country and puts forward some suggestions.
