职务犯罪侦查推测,是指在职务犯罪侦查过程中,根据已经掌握的事实材料,结合相关知识经验,借助逻辑的方法,对需要查明的问题作出推测性或者假定性的说明。职务犯罪侦查推测具有穷尽性、针对性和合理性三个特征,立案材料的真实有效、侦查人员的逻辑推理能力和生活与工作经验是形成职务犯罪侦查推测的影响因素,因此也应当从这三方面提升职务犯罪侦查推测能力。
Speculative crime detection refers to the speculation or presumption of the problems that need to be identified according to the factual materials that have been mastered in the course of the investigation of job-related crimes by combining the relevant knowledge and experience with the help of logical methods. The investigation of job-related crimes has the characteristics of exhaustiveness, pertinence and rationality, and the authenticity of the filing materials.
