在英美陪审制度是否具有生命力的问题上,以往观点倾向于认定其正走向衰落。这种观点虽有一定的道理,但事实是否果真如此,值得商榷。本文指出通过对英美法系国家最新资料的考察与分析后,不难发现,陪审制度在死刑案件中仍然发挥重要作用。更重要的是,陪审制度实际上已经成为一种诉讼文化深深扎根于社会系统中,难以剥离。在线陪审团的出现,更是揭开了陪审团未来崭新的蓝图。因此,可以得出一个略具挑战性的结论,即英美陪审制度没有衰落,价值犹存。研究英美陪审制度对我国人民陪审员制度的完善具有十分重要的启示意义。
On the issue of whether the Anglo-American jury system has vitality, past opinions tend to assume that it is heading for decline. Although this view has some truth, it is debatable whether this is the case. This article points out that after examining and analyzing the latest information from the Anglo-American legal system countries, it is not difficult to find that the jury system still plays an important role in the death penalty cases. More importantly, the jury system has actually become a litigation culture deeply rooted in the social system, it is difficult to divest. The emergence of an online jury opens up a brand new blueprint for the future of the jury. Therefore, we can come to a slightly challenging conclusion that there is no decline in the Anglo-American system of jury and its value remains. It is of great significance to study the system of jury accreditation in the United States and the United States on the perfection of the people’s assessor system in our country.
