一、法律规避的概念:学界的探讨在考察规避法律的概念之前,首先探讨一下“规避”与“法律规避”。《现代汉语词典》解释“规避”为“设法避开;躲避”。受文化因素影响,西方规则观念较为深厚,我国相对而言,规则意识比较淡漠,因而规避情形更多的出现在我国。而目前,国内学界对法律规避一词的界定比较混乱,使得原本国际法视野下的法律规避与国内法语境下的规避法律无法区分。法律规避与
