实践中有涉及死者名誉的法律保护问题,其指导理论尚有待充实。理论充实之基础,则在于探究死者的名誉在民法上为何性质、能否得到保护、如何进行保护,从而进一步确定请求权主体与保护期限,完善一整套保护模式,有助于在民法的裁判规范之属性下,法官作为主体为司法裁判时的法律准绳。
In practice there are legal protection issues concerning the reputation of the deceased, and the guiding theory has yet to be fulfilled. The basis of enrichment of theory lies in exploring why the reputation of the deceased is civil law, whether it can be protected and how to carry out protection so as to further determine the subject of the claim and the term of protection and improve a complete set of protection modes, At the same time, the judge as the main body is the criterion of law in judicial adjudication.
