一、引言“金山轮”案中,金山轮是一艘32年船龄的老船舶。2007年属于香港金喜船务公司的金山轮遭遇8~9级风浪与涌浪的袭击,导致船体开裂而沉没。在关于该船舶是否适船的问题上,我国法院曾作出以下裁判:“金山轮虽为1976年建造的老龄船,但其船籍国允许其经营船运,其应属适航船舶。”~①国际船运界和世界海事机构中认为20年船龄以上的船舶均属于“老龄船舶”。在“金山轮”案中,拥有32年船龄的船舶在国际船运界中早已成为老龄船
First, the introduction “Jinshan round ” case, Jinshan round is a 32-year-old old ship.
