城中村,作为征地后剩余的集体土地,拆迁应用的是集体土地拆迁办法和标准,但其与城市距离较近,有的甚至在城市之中,周边的城镇房屋价格较高,因此补偿和村民的心理预期之间有较大差距,因此造成城中村改造工作难以进行。本文以南京市城中村改造工作为例,分析了其在城中村集体土地上住宅房屋的拆迁补偿办法,结合城中村特点,提出其不合理性。并结合现行的城镇房屋拆迁政策,提出较为适宜的补偿办法。
