刑事执法效果评估机制研究是刑事法学领域的新课题,刑事执法效果评估机制研究有着重大的理论和实践意义。刑事执法效果,是指刑事执法活动产生对社会关系、社会秩序、犯罪人、被害人等方面产生的影响与结果,四个方面有机统一即组成了刑事执法效果。刑事执法具有政治性、法律性、社会性等基本特征。影响执法效果的因素包括执法者本质、执法环境、刑事法律体系、执法监督动向、执法数量。刑事执法效果的评估标准有政治标准、法律标准、经济标准、社会标准、文化标准。
