少数民族非物质文化遗产保有者与利用者存在利益冲突。法律是正当性评判的结果。少数民族非物质文化遗产私权保护的正当性是确认并保护利益主体的基础。基于利益、法理、经济的多维视角,少数民族非物质文化遗产私权保护具有必要性和合理性。
There is a conflict of interest between the holders and users of the intangible cultural heritage of ethnic minorities. Law is the result of justification. The legitimacy of the protection of private rights of intangible cultural heritage of ethnic minorities is the basis for identifying and protecting the interests of stakeholders. Based on multidimensional perspectives of interests, jurisprudence and economy, the protection of the private rights of intangible cultural heritage of ethnic minorities is necessary and reasonable.
