国际航空运输责任范围,也可称是航空运输承运人承担责任的实质条件,它指承运人适用经1955年海牙议定书修改的华沙公约规定的特定责任所具备的直接内容。这种责任范围可从两个角度进行分类,从责任范围的广度来说;它指承运人应进行赔偿的横向责任。公约第17、18条规定的关于发生地点以及过程内容,就是横向责任,它指承运人在什么情况下应对原告的损害进行赔偿。从责任范围的深度来说,它指承运人应进行赔偿的纵向责任。公约第17条规定的关于旅客因死亡、受伤、身体上的任何损害之内容,公约第18条有关行李货物的损坏程度之内容,属于一种纵向责任,它表明承运人对旅客、行李或货物的损害应进行赔偿。
The scope of international air transport responsibility, which can also be described as a substantive condition for liability of an air transport carrier, refers to the direct content of the carrier’s specific liability under the Warsaw Convention as modified by the 1955 Hague protocol. This scope of responsibility can be categorized from two perspectives, in terms of breadth of responsibility; it refers to the horizontal responsibility of the carrier for compensation. Article 17 and 18 of the Convention on the place of occurrence and the content of the process are horizontal obligations and refer to the circumstances under which the carrier should compensate the plaintiff for damages. From the depth of the scope of responsibility, it refers to the carrier’s vertical liability for compensation. Article 18 of the Convention concerning the extent of damage to passengers due to death, injury and physical injury, as well as the extent of damage to the goods in the baggage of the Convention, is a matter of vertical responsibility and indicates that the carrier’s liability to passengers, baggage or cargo The damages should be compensated.
