本文介绍并分析了印度商业秘密保护的法律框架,指出印度商业秘密保护缺乏适当的法律框架,主要是通过《印度合同法》、《印度版权法》、《印度竞争法》等法律来保护商业秘密。这种分散的立法易导致各法律之间的冲突,不利于司法适用,也增加了企业保护商业秘密或秘密信息的成本。印度现有的商业秘密保护法律变革仍未形成统一立法的趋势。在印度经济社会中,培育尊重商业秘密的意识和建立非公开信息为他人专有资产的文化氛围,将会有一段很长的路要走。
This article introduces and analyzes the legal framework of India’s commercial secrets protection and points out that there is no proper legal framework for the protection of trade secrets in India. The protection of trade secrets is mainly through laws such as “Indian Contract Law”, “Indian Copyright Law” and “Indian Competition Law” . Such fragmented legislation can easily lead to conflicts among various laws, to the detriment of the administration of justice, and to the costs of protecting business secrets or confidential information. India’s existing trade secrets protection law reform has not yet formed a unified legislative trend. In India’s economy and society, there will be a long way to go in cultivating a sense of respect for trade secrets and establishing a cultural atmosphere in which private information is the exclusive asset of others.
