在共同犯罪致死一人的案件中,要切实贯彻严格控制和慎用死刑的刑事政策,对于地位、作用较次的被告人,在适用死刑上应当区别对待;死刑案件的事实认定,同其他刑事案件一样,会带有主观的选择色彩,离不开价值观念的指引。刑事法官应自觉、自主地超越法条审视自己的价值立场和观念,以更加准确地认定案件事实,作出法律效果和社会效果更好的司法裁判。
