司法公正是现代社会政治民主进步的重要标志,也是现代国家经济发展和社会稳定的重要保证。针对相对滞后的司法体制和工作机制与人民群众对司法公正日益增长的需求不相适应这一矛盾,必须建立司法公正的保障机制。司法公正保障机制的建立根本在于司法改革,这种改革要求必须建立政治、体制、监督和主体的保障机制,以使司法权的运行符合现代社会民主法治的需要。
Judicial fairness is an important symbol of political democracy in modern society and an important guarantee for economic development and social stability in modern countries. In view of the contradiction between the relatively lagging judicial system and working mechanism and the people’s incompatibility with the ever-increasing demand for judicial fairness, it is necessary to establish a judicial guarantee mechanism. The establishment of the judicial guarantee system is essentially based on the judicial reform. This kind of reform requires that the political, institutional, supervisory and subjective guarantee mechanisms must be established so that the operation of the judicial power meets the needs of the democratic rule of law in modern society.
