在WTO的TRIPS协定中,地理标志知识产权保护对农产品国际贸易有特别重要的意义。我国具有悠远的农耕文明和深厚的饮食文化,许多以原产地名称闻名的传统名、特、优农产品具有保护价值。地理标志保护产品的现实市场,将积极引导这些产品在原产地区域的产业化;对地理标志保护产品通用技术及产品质量、特性等方面的强制性国家标准要求,将有效促进相关农产品生产的标准化;地理标志使用的地域外排他性与地域内共有性,为相关产品企业实施品牌战略提供了竞争和协作的“高位平台”。实行地理标志保护将发掘和实现我国农产品国际贸易的比较优势,是入世后农业须着力把握的机遇之一。
In the TRIPS agreement of the WTO, the protection of intellectual property rights for geographical indications has special significance for the international trade of agricultural products. China has a long-range farming culture and a deep food culture. Many traditional names, special and excellent agricultural products known for their origin have protective value. The actual market for geographical indication protection products will actively guide the industrialization of these products in the country of origin; the mandatory national standards for general-purpose technologies and product quality and characteristics of geographical indication protection products will effectively promote the standardization of production of related agricultural products. The geographical exclusivity and geographical commonality used by geographical indications provide a “high platform” for competition and collaboration for related product companies to implement brand strategy. The implementation of geographical indication protection will unearth and realize the comparative advantages of China’s agricultural products in international trade, which is one of the opportunities for agriculture to grasp after the WTO entry.
