刑讯逼供是我国法律所严厉禁止的行为,然而在司法实践中,这一行为却频频发生,并带有一定的普遍性。我国是世界上封建社会存续时间最长的国家,犯罪嫌疑人、被告人被先入为主地推定为有罪,在一系列的证据已经证明该犯罪嫌疑人有罪时,为获取其供述而实施刑讯逼供是再自然不过的事情了。这是刑讯逼供至今仍然难以禁绝的主要原因。刑讯逼供严重违背了国家的法律,侵犯了公民的合法权益,破坏了人们对法律的信仰,且极易引起冤假错案的发生。权衡利弊,自当坚决反对刑讯逼供。
