本文共分为四部分。第一部分(《欧洲合同法原则》的源起)介绍了起草《欧洲合同法原则》的欧洲统一国际私法运动的背景。第二部分(《欧洲合同法原则》的统一方法)分析了《欧洲合同法原则》为实现欧洲合同法统一这一目标所采用的几种方法。第三部分(《欧洲合同法原则》内容上的显著特征)从比较法的角度指出《欧洲合同法原则》在内容上与其他国际统一合同法典的不同之处。最后对全文作了总结。
This article is divided into four parts. The first part (Originating from the “Principles of European Contract Law”) introduces the background to the European Uniform Civil Rights Movement that drafted the “Principles of European Contract Law.” The second part (a uniform approach to the principle of European contract law) analyzes several approaches adopted by the European Principles of Contract Law to achieve the goal of unifying European contract law. The third part (the salient features in the “Principles of European Contract Law”) points out from the perspective of comparative law the differences between the “Principles of European Contract Law” and other codes of international unification. Finally, the full text is summarized.
