“法律是道德的底线”这句话说明了法律是道德的体现,是最低程度的道德。但同时也会让人疑惑——认定某一行为是否违法、罪与非罪的考虑因素之中是否渗透着对行为道德性的评价?法律能否强制执行道德?本文结合哈特《法律、自由与道德》一书对“夫妻黄碟”和“南京教授换偶”案所涉的法律问题进行了思考与回答。
