在《物权法》实施后近两年的时间里,有关动产抵押的理论研究取得了很大的进步,动产抵押制度的实践也有了较大的突破。但是,不可否认的是动产抵押在理论上及在实践中仍存在着许多问题需要进一步解决与完善。本文主要结合目前世界金融危机的情况与我国动产抵押制度的现状提出完善我国动产抵押制度的相关建议。
In the nearly two years since the implementation of the Property Law, great progress has been made in the theoretical researches on the mortgage of chattel, and the practice of the chattel mortgage has also made great breakthroughs. However, it is undeniable that there are still many problems that need to be solved and improved in theory and in practice. In this paper, we combine the current situation of the world financial crisis and the current situation of China’s real estate mortgage system to put forward some suggestions to improve China’s real estate mortgage system.
