一些行政机关制订的部门规章及地方政府规章普遍存在违规立法、朝令夕改、墨守成规的问题。这些问题涉及面广且长期存在,给行政管理带来明显的负面影响。本文以高校文书档案为例,采用数据表格及比较的方法,对这些问题进行讨论。一、瑕疵表现(一)违规立标。指的是部门规章、地方政府规章里的具体标准违背国务院的行政法规规定,即俗称的上有政策,下有对策。这里列举两个文书档案案例。一是地方高考名册公章规格违规。国务院1993年
