《农村安全用电规程》DL493-92第6·5条规定:严禁私设电网防盗、捕鼠、狩猎和用电捕鱼。 据有关部门近年来的不完全统计,全国每年因用电捕鱼而丧生的数以千计,且仍有上升趋势。 例1 1998年初夏。黄河岸边某县农民徐根岭,看到村民家的山羊相继被盗,突发奇想:如果在羊圈周围架上电网,盗贼也许就不敢问津了。6月10日,徐根岭买来裸铝线,在自家羊圈周围架上了电网,每到晚上就通上电。6月12日凌晨2时许,本村村民秦学堂酒后回家,路过徐根岭的羊圈时不幸触电,当被人发现时,秦学堂已气绝身亡。 法院审理认为,被告人徐根岭为防盗私设电网,预见到可能会发生他人触电,虽然告诉了街邻夜间通电,仍导致发生他人触电死亡的后果。其行为已构成过失致人死亡罪。遂依法对被告人徐根岭判处有期徒刑6年,赔偿被害人经济损失14080元。 例2 1995年5月14日是星期天。长江岸边某县村民石小山,见前几天有人在村附近的河里用电捕了不少鱼,自己也要试一试。这天,他把电线、网兜准备好来到河边,将电线挂接在提灌站的低压线路上,电线的另一端用一根竹杆拴着放在水中开始捕鱼。不大一会儿,就捕到大大小小不少鱼,便高兴地将鱼送到家中又回来继续捕鱼。在家做作业的侄子小锁看到叔叔一会儿就捕到那么多鱼,便悄悄地放下作业,偷偷地?
