考察裁判官的历史,不难发现,其产生到结束的这段时期,正是罗马法经历严格的形式主义逐渐被抛弃而开始重视实质内容的时期。裁判官在罗马法从重形式向重实质内容的转变过程中,发挥了承前启后的作用,对后来罗马法的完善具有重要影响。
When examining the history of magistrates, it is not hard to find that the period from its birth to the end was the period when the Roman law was gradually abandoned by strict formalism and began to attach importance to the substance. The magistrate played an important role in the transition from heavy form to substantive content in Roman law and has an important influence on the perfection of the Roman law.
