我国检察机关是宪法规定的国家的法律监督机关,保证宪法法律的统一正确实施是检察机关崇高的法律使命和法定职责。检察机关的法律监督是维护宪法权威的重要方式,在确保宪法的实施和监督宪法的实施中有着重大的职能作用,主要通过以下工作发挥职能作用:通过依法行使法律监督职能保证宪法法律的统一正确实施,依法严格查处公职人员贪污受贿、失职渎职、执法犯法的职务犯罪行为,在依法履行职责过程中有效开展预防执法不严、司法不公的治本工作,必然要求检察机关自身的公正、廉洁、规范、文明、优质、阳光司法。为了真正发挥检察机关在法治监督体系中维护宪法权威、保证宪法法律统一正确实施中的重要而独特的作用,应当从两个主要方面着力完善中国检察制度:一方面,要从严密法治监督体系出发,制定加强检察机关法律监督的专门法律;另一方面,以全面深化司法体制改革为契机,推进检察机关开展法律监督体制机制的完善。

In order to give play to the procuratorial organs’ important and unique role in safeguarding the constitutional authority in the legal supervision system and ensuring the uniform and correct implementation of the constitutional law, efforts should be made to improve the procuratorial system in China from two major aspects. On the one hand, we should proceed from a strict supervision system of the rule of law On the other hand, taking the opportunity of deepening the reform of the judicial system, the procuratorial organs should be encouraged to improve their system and mechanisms for legal supervision.
