为担保债权而转移不动产所有权的不动产转让担保,是在韩国判例和学说中都被认可的一种非典型担保。如果仅根据限制债权人的暴利行为的《韩国民法》第607条和608条规定,则是存在一些不足之处的。所以在1983年,韩国为明确规制转让担保制度,制定了《关于假登记担保的法律》(以下称《假登记担保法》)。不动产的转让担保有很多种形式,其中因消费借贷,以担保债务为目的而转移不动产所有权的担保权,也是假登记担保法的适用对象。下面,笔者就对韩国的假登记担保法进行概括性的介绍。
The real estate transfer guarantee for the transfer of ownership of real estate for the purpose of securing claims is an atypical guarantee recognized both in Korean jurisprudence and doctrine. There are some shortcomings if they are based solely on the provisions of Articles 607 and 608 of the Korean Civil Code that limit the perversions of creditors. Therefore, in 1983, South Korea formulated the “Law on Security of Fake Registrations” (hereinafter referred to as the “Fake Registration Guarantee Law”) in order to explicitly regulate the transfer guarantee system. There are many forms of security for the transfer of immovable property. Among them, the security right to transfer the ownership of immovable property for the purposes of consumer loans and for the purpose of guaranteeing debts is also the applicable object of the law of guarantee of fake registration. Next, I will give a general introduction of Korea’s Fiduciary Security Law.
