随着我国市场经济的深入,市场转型的需要,劳动者已成为社会人数较多的一个阶层。劳动者要求参与企业的利益分配、提高自身的地位等诉求,由于劳动关系主体双方力量的失衡问题越来越严重,劳动者只能寄希望于代表其利益的工会能为其争取合法权益。本文提出我国工会在劳动者维权中的角色缺位问题,分析产生这个问题的原因,主要有历史方面的原因以及工会法律规定的不全面、操作性不强等,进而提出了解决工会角色缺位问题的对策措施。
With the deepening of China’s market economy and the need of market transformation, laborers have become a stratum with a large number of people in society. As laborers demand to participate in the distribution of profits of enterprises and improve their own status, the labor imbalance between the two sides of the labor relationship becomes more and more serious. Workers can only hope that the unions representing their interests can fight for their legitimate rights and interests. This paper puts forward the problem that the trade unions in China lack the role of laborers’ right protection, analyzes the causes of this problem, mainly because of the historical reasons and the incompleteness of the laws and regulations of the trade unions and the poor operability.
