从教学与研究关系理论的角度而言,法学研究在科学性上的阙如导致了法学教育的困境。判解学分析法作为一种法学研究方法,吸取了传统研究方法思辨的精髓,以及新型研究方法对现实回应性的长处。法学教育者宜在该方法的指引下重构课堂案例教学法,从而使学生在提高知识与理论素养的同时,增强学理创新能力与实践操作能力。为充分发挥判解学分析法对案例教学的指引作用,教育者需要在相应激励机制的促动下,消除高校教育去哲学化的不良影响并将科研成果转化为教学内容。
From the perspective of the relationship theory between teaching and research, the scarcity of jurisprudence in legal science has led to the dilemma of legal education. As a method of jurisprudence research, the method of analytic analysis absorbs the essence of the traditional method of thinking and the advantages of the new method of research to the reality. Under the guidance of this method, law educators should reconstruct the classroom case teaching method, so that students can improve their ability of theoretical innovation and practical operation while improving knowledge and theoretical accomplishment. In order to give full play to the guiding role of judgment analysis method in case teaching, educators need to eliminate the adverse effects of philosophicalization of higher education and promote the transformation of scientific research into teaching content, under the impetus of the corresponding incentive mechanism.
