我国自古就重视口供,但施行“刑讯合法”的残酷刑法,至此我国在这方面的规定仍存在理论基础薄弱,内容欠缺的弊端。本文指出为了保护人权,使我国法律融于国际先进法律之中,保证国际间政治、经济、文化等友好往来,妥善解决国际、国内纠纷,维护法律的权威,实现法律的公平正义,急需建立一套完备的非法证据排除规则的法律制度。
Since ancient times, our country has attached great importance to oral confession, but cruel tort law of “torture lawfulness” has been implemented. At this point, our country still has the defects of weak theoretical foundation and lack of content in this respect. This article points out that in order to protect human rights, to bring our laws into the most advanced international law, to ensure the friendly exchanges of politics, economy and culture in the world, to properly resolve international and domestic disputes, to maintain the authority of law and to realize fair and just laws, Set complete legal system of illegal evidence exclusion rules.
