国际法上的主权问题,历来是一个有颇多争议的门题,不同时代不同国家的学者从不同立场出发,提出了不同观点。随着国际秩序的不断变动,国际关系向纵深发展,国际法实践中出现了一些新的情况,给传统的主权原则提出了新的问题。本文仅对当前与主权原则有关的几个问题进行浅要的探索。 (一)主权权力的“让渡”问题传统国际法认为主权是国家固有的属性,具有完整性和不可分割性。但是随着一些国际组织的出现,尤其是欧盟的建立,一些学者提出了主权权力“让渡”理论。如前所述,主权不是也不应当是绝对的,主权权力的行使要受国际法的限制。同理,国家之间缔结的符合国际法的条约可以规定对主权的限制。那么,国家通过和约将自己的主权“让渡”一部分给国际组织,
The issue of sovereignty in international law has always been a topic of considerable controversy. Different scholars from different countries from different times have come up with different points of view from different standpoints. With the ever-changing international order, international relations have developed in depth and some new situations have emerged in the practice of international law, posing new questions to the traditional principle of sovereignty. This article only briefly explores the current issues related to the principle of sovereignty. (1) The issue of “transfer ” of sovereign power Traditional international law holds that sovereignty is an inherent property of the state, with completeness and indivisibility. However, with the advent of some international organizations, especially the establishment of the European Union, some scholars have put forward the sovereign power “transfer” theory. As mentioned earlier, sovereignty should not and should not be absolute. The exercise of sovereign power is subject to the restrictions of international law. By the same token, the conclusion of treaties in conformity with international law between nations can stipulate restrictions on sovereignty.
