驰名商标是市场经济不断成熟的产物,也是生产、经营者持续从商培养的成果,它不仅发挥商标识别出处的基本功能,而且在吸引注意力,表彰顾客身份方面具有普通商标所不具备的作用。如何保护驰名商标是我国商标法发展的一个重要方面,同时,它也是我国建立创新型国家的必然要求。针对我国对驰名商标保护的立法与司法现状,我国仍应进一步完善我国商标法对驰名商标的保护,更好的促进我国知识产权战略的实施。

They not only give play to the basic functions of trademark recognition, but also have the functions that ordinary logos do not have in attracting attention and recognizing customers. . How to protect well-known trademarks is an important aspect of the development of our country’s trademark law. At the same time, it is also a necessary requirement of our country to establish an innovative country. Aiming at the status quo of legislation and judicature for the protection of well-known trademarks in our country, our country should further improve the protection of well-known trademarks by our country’s trademark law and better promote the implementation of our intellectual property strategy.
