执行救助是我国当前解决执行难问题的手段之一,完善的执行救助制度在提升司法公信力,保障当事人基本人权方面有重要功效。现有的执行救助制度过于注重纠纷解决,对执行救助制度的性质归属没有清晰的定位;在救助落实方面过度依赖执行机构,未与社会救助制度充分对接。笔者以此为切入点,望能引起对该制度在理论界的充分讨论。
The implementation of aid is one of the means to solve the current difficult problem in our country. A sound enforcement aid system plays an important role in enhancing the credibility of the judiciary and protecting the basic human rights of the parties concerned. The existing executive aid system is too focused on dispute resolution and has no clear position on the nature of the implementation of the aid system. Overdependence on the implementing agencies in the implementation of the aid system has not been fully linked with the social assistance system. The author as a starting point, hope can cause the system in the theoretical circle of full discussion.
