刑事被害人是犯罪行为的直接侵害者,而在司法实践中,他们的权益往往无法得到有效的救济。目前,一些国家先后建立了刑事被害人国家补偿制度以更好地保护被害人,我国还没有建立这一制度。在建设社会主义和谐社会的进程中,我们也应立足中国国情,借鉴国外经验,早日建立符合中国国情的刑事被害人国家补偿制度。
Criminal victims are the direct offenders of criminal acts, but in judicial practice, their rights and interests often can not be effectively remedied. At present, some countries have set up state compensation systems for criminal victims in order to better protect their victims. Our country has not yet established such a system. In the process of building a socialist harmonious society, we should also base ourselves on China’s national conditions and learn from foreign experience to establish an early state compensation system for criminal victims in line with China’s national conditions.
